Terms of Service

In short
Use Dataspline lawfully and don’t abuse it. You keep ownership of the keywords you submit; you grant us a limited licence to process them so we can return results.
Search-volume figures are estimates provided “as is”. Our liability is limited as described below. These Terms are governed by the laws stated in section 11.
01Acceptance of these Terms
By accessing or using the Service you confirm that you can form a binding contract and that you will comply with these Terms and all applicable laws. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.
02The Service
Dataspline lets you submit keywords and receive estimated monthly search-volume data, sourced through our data engine and returned across several speed tiers. We may add, change, or remove features, and we may impose reasonable usage limits to keep the Service reliable for everyone.
03Tiers, pricing, and billing
The Service offers Instant, Normal, and Economic tiers, each with its own price, turnaround time, and per-check limits shown in the app. Prices are displayed per check. Where paid billing is enabled, applicable fees and taxes will be disclosed before you are charged, and price changes will not apply retroactively.
04Acceptable use
You agree not to:
- Use the Service to violate any law or third-party right, including intellectual-property or privacy rights.
- Attempt to identify, scrape, reverse-engineer, or circumvent our data engine or its underlying providers.
- Interfere with, overload, or disrupt the Service, or bypass rate limits or security controls.
- Resell or redistribute raw results in a way that competes with the Service, except as expressly permitted.
- Submit unlawful, infringing, or malicious content.
05Your content and licence
You retain all rights to the keywords and other content you submit (“Your Content”). You grant Dataspline a limited, worldwide, non-exclusive licence to host, process, and transmit Your Content solely to operate and provide the Service to you. You are responsible for ensuring you have the rights to submit Your Content.
06Intellectual property
The Service, including its software, design, branding, and the arrangement of results, is owned by Dataspline and protected by intellectual-property laws. Except for the rights expressly granted here, we reserve all rights. “Dataspline” and our logo are our trademarks and may not be used without permission.
07Data accuracy and availability
Search-volume figures are estimates derived from third-party data and modelling. They may not reflect actual search activity and should not be relied upon as the sole basis for decisions. We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free.
08Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy, and non-infringement. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
09Limitation of liability
To the maximum extent permitted by law, Dataspline will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the greater of the amounts you paid to us in the three months before the claim, or €100. Nothing in these Terms limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence.
10Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination, including ownership, disclaimers, and limitations of liability, will survive.
11Governing law and disputes
These Terms are governed by the laws of the Dataspline entity’s place of establishment in the EU, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction, except that if you are a consumer, you benefit from any mandatory protections of the law of your country of residence.
12Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date, and for material changes we will provide reasonable notice. Continued use after changes take effect constitutes acceptance.
